Shader commercial license terms — Jae · Version 1.1

Shader commercial licensing

These terms apply to every commercial license bought from Jae (“the Author”). The shader licensed (“the Work”) is the shader named on the purchase invoice, as published by the Author on Shadertoy at https://www.shadertoy.com/user/Jaenam, including later versions the Author publishes there under the same name. The license type (Non-exclusive or Exclusive) is also named on the invoice. The person or company named on the invoice is “the Licensee”.

Unless stated otherwise in its code, the Work is publicly available under the Creative Commons BY-NC-SA 3.0 license, which does not allow commercial use. This license grants the Licensee commercial rights in addition to that public license.

Payment is processed by Stripe, sold through Link, which acts as merchant of record and issues the invoice. The license itself is granted by the Author.

Part A — Non-exclusive license

Grant

Once payment is complete, the Author grants the Licensee a perpetual, worldwide, non-exclusive, non-transferable, non-sublicensable right to use, reproduce, modify, and incorporate the Work for commercial purposes in one product, website, or project (“the Licensee Product”). A Licensee Product built for a single end client counts as one project.

Permitted uses

  1. Use the Work, as-is or modified, in the Licensee Product.

  2. Publicly display the Work as part of the Licensee Product.

  3. Create variations of the Work for use within the Licensee Product.

Restrictions

  1. The Licensee may not resell, redistribute, or give away the Work itself, on its own or as part of a template, remixable project, component library, asset pack, or marketplace item, whether paid or free.

  2. The Licensee may not sublicense the Work separately from the Licensee Product.

  3. Commercial use in any additional product or project requires a separate license.

  4. The Licensee may not use the Work as training data for machine-learning models without the Author’s written consent.

  5. The Licensee may not claim authorship of the Work.

Attribution

If the Licensee Product has a credits, about, or colophon section, the Licensee shall credit the Author there (e.g. “Shader by Jae”). Otherwise attribution is appreciated but not required. Attribution comments in the source code must not be removed.

Scope

The Author may continue to license the Work commercially to others. If the Author later grants an exclusive license to someone else, this license remains valid.

Part B — Exclusive license

Grant

Once payment is complete, the Author grants the Licensee a perpetual, worldwide, exclusive right to use, reproduce, modify, and incorporate the Work for commercial purposes in any number of the Licensee’s own products, websites, and projects, and to sublicense the Work as part of those products. This license may only be transferred with the Author’s written consent, or as part of a sale of the Licensee’s business.

Author’s commitments

From the purchase date, the Author will not sell or grant new commercial licenses for the Work to anyone else, and will not use the Work in the Author’s own commercial products.

What the Author keeps

  1. Copyright in the Work stays with the Author. This is an exclusive license, not a transfer of ownership.

  2. Commercial licenses granted before the purchase date remain valid. The Author will disclose them on request.

  3. The Author may reuse the general techniques, code patterns, and know-how in the Work in other works, as long as those works are not substantially the same as the Work.

  4. The Author may show the Work (images and video) in a personal portfolio and on social media, unless agreed otherwise in writing.

  5. The Work remains publicly available on Shadertoy under CC BY-NC-SA 3.0. Exclusivity applies to commercial use only.

Restrictions

Restrictions 1, 4, and 5 of Part A also apply to this license.

General terms

Applies to both licenses

Updates and support

Later versions of the Work that the Author publishes on Shadertoy under the same name are covered by this license, but the Author has no obligation to publish updates. Support and modifications are not included unless agreed in writing.

Warranty and liability

The Work is provided “as is”, without warranty of any kind, including compatibility with every browser, device, or GPU. To the extent permitted by law, the Author’s total liability is limited to the amount paid for the license.

Termination

If the Licensee materially breaches these terms and does not fix the breach within 30 days of written notice, the license ends and the Licensee must stop using the Work commercially in new products.

Dispute resolution

This license is governed by the laws of the country in which the Author’s business is established. Payment is processed by Stripe, sold through Link as merchant of record, which handles payment disputes and refund requests under its standard policy. Because the Work is publicly accessible before purchase, the license is otherwise non-refundable once payment is complete, except where the law requires otherwise.

Proof of license

The purchase invoice together with these terms (in the version in effect at the time of purchase) is proof of a valid license.
